All metal hip recipients need legal evaluation

ZeiglerSeniorNews.com -- Patients who received a metal hip implant may have a legal claim for money damages. Even if the patient does not already have problems, he will possibly have problems in the future. The safe thing to do is to get a free legal evaluation.

The Food and Drug Administration (FDA) has ordered a review of all metal-on-metal hip implants. This is because of mounting patient complaints. A growing number of metal hip replacement recipients suffer pain, swelling, problems in walking, loosening, fractures, and dislocations. Others have no noticeable symptoms and may not know about elevated levels of cobalt or chromium. Those metals levels can cause serious physical problems later.

Hip replacement recipients without noticeable symptoms may make the mistake of waiting. If they have problems later, they could be barred from compensation by a statutue of limitations deadline.

Hip replacement parts recalled include Pinnacle, DePuy ASR XL Acetabular System, which is the cup portion of a replacement hip joint and DePuy ASR Hip Resurfacing System. Resurfacing involves implanting a cup and capping the ball at the top of the thighbone in a procedure that preserves more bone than traditional replacements. Resurfacing impacts mostly younger patients.

DePuy hip urgency

The legal deadline may or may not be passed for about 93,000 people who had received DePuy metal hip replacements. Most legal experts says Aug. 24 was the safest bet for the statute of limitations deadline for DePuy claims.

Recipients of DePuy implants can be barred from compensation if they delay filing their claims. The only way to find out if you can still file it to file and see what happens. May be a waste of time, but maybe not.

DePuy, a subsidiary of Johnson & Johnson, issued a voluntary recall of the suspect parts August 24, 2010. A major issue is the high rate of repeat surgeries needed.

WHAT IS THE STATUTE OF LIMITATIONS DEADLINE? It varies from state to state and varies with different legal "causes of action." Most deadlines are two years. Since the DePuy hip replacement device was recalled on Aug. 24, 2010, it was advisable that a recipient start their claim before now.

If a patient does not know the type (brand) of his implant, he should contact the office of his orthopedic surgeon. In many cases, a review of the medical records will indicate the vendor of the parts.

Physicians were notified about problems with the DePuy hip replacement parts in March 2011.

The decision to recall the parts was made when a study confirmed a five-year rate of corrective surgeries for about 12 percent with the ASR resurfacing system and about 13 percent with the ASR XL system, which was higher than the expected rate.

Patients who reported problems in the first five years and had revision surgery reported a variety of symptoms, including pain, swelling and problems walking. These symptoms are expected for patients following a hip replacement, but can be a sign that something is wrong if they continue or come back frequently. These symptoms may indicate serious problems, including:

·         Loosening - when the implant does not stay attached to the bone in the correct position

·         Fracture - where the bone around the implant may have broken

·         Dislocation - where the two parts of the implant that move against each other are no longer aligned

Hip surgery patients who suffer these complications are more likely to later need home care, assisted living or nursing home admission. Life-long health care costs for victims of defective hip surgeries can be substantially higher than for other seniors.

Those pursuing metal hip claims will need to asset-protect the proceeds to qualify for Medicaid nursing coverage or veterans’ aid and attendance. Those who fail or decline to pursue the claims may be penalized for nursing care under Medicaid’s five-year “lookback period.”
